1. Introduction
Welcome to HairTRACK, a mobile application developed by DS Healthcare Group, Inc. ("Company," "we," "us," or "our"). By downloading, installing, or using the HairTRACK application (the "App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with these Terms, you must discontinue use of the App immediately.

2. Purpose of the App
HairTRACK is designed as a personal reference tool that allows users to track the progress of their hair treatment by taking before and after pictures for comparison. The App is not intended for medical analysis, diagnosis, or treatment. Users should seek professional evaluation and medical advice from a licensed physician or qualified healthcare provider for any hair-related or medical concerns.

3. No Medical Advice or Liability

· HairTRACK is not a medical tool and does not provide medical analysis, diagnosis, or treatment recommendations.

· Any decisions made based on the App’s functionality, data, or images are the sole responsibility of the user.

· The Company expressly disclaims any liability for any health-related decisions made based on the use of the App.

· Users are encouraged to consult a licensed physician for any medical evaluations or treatment plans.

4. User Content and Data Ownership

· By uploading images or any other data ("User Content") to the App, you grant DS Healthcare Group, Inc. an exclusive, perpetual, irrevocable, worldwide, royalty-free, and transferable license to use, store, reproduce, modify, create derivative works, distribute, and display such User Content for purposes related to the operation of the App and other business activities.

· The Company reserves the right to all images and data uploaded to the App by its users.

· Users acknowledge that the Company is not responsible for lost, deleted, or modified content.

5. Permitted Use

· The App is provided for personal and non-commercial use only.

· Users agree not to misuse the App, including but not limited to:

o Uploading misleading, harmful, or offensive content.

o Using the App in any way that violates applicable laws.

o Attempting to reverse-engineer, modify, or exploit the App for unauthorized purposes.

6. Limitation of Liability
To the fullest extent permitted by law:

· The Company and its affiliates shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the App.

· The App is provided "as is" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

· The Company does not warrant that the App will be uninterrupted, error-free, or free of viruses or harmful components.

7. Indemnification
Users agree to indemnify and hold harmless DS Healthcare Group, Inc., its officers, employees, and affiliates from any claims, liabilities, damages, or costs arising from:

· The use of the App.

· Violation of these Terms.

· Any reliance on data or images captured within the App.
